ANTIQUE / ESTATE AUCTION — TERMS & CONDITIONS OF SALE

Sales Tax
As required by Nevada state statute, sales tax is charged on the total of the bid price plus the Buyer’s Premium,
unless the purchaser provides valid proof of exemption at checkout. No claims of exemption will be accepted at
checkout. Buyers unable to provide valid exemption documentation must pay sales tax and may later seek a refund
directly from the State of Nevada.

Buyer’s Premium
A Buyer’s Premium will be added to all purchases as follows:
 12% for payments made by cash or check
 15% for payments made by credit or debit card
 For items sold at $1,000 or more:
o 10% Buyer’s Premium applies when paying by cash or check
o 13% Buyer’s Premium applies when paying by credit or debit card

Bidder Registration
All bidders must register with a valid credit or debit card and be ID-verified prior to bidding. By registering, bidders
acknowledge and agree to all Lightning Auctions terms and conditions.

Accepted Payments
We accept Cash, Cashier’s Check, Money Order, Visa, and MasterCard. All purchases must be paid in full prior to
removal. A paid receipt from Lightning Auctions is required for pickup.

Item Removal & Responsibility
Lightning Auctions is not responsible for preview or removal. All items must be removed by the posted deadline.
If items are not removed or paid for within 7 days after the auction ends, the bidder’s registered card will
automatically be charged for the full invoice amount.

If items remain unclaimed after payment is processed, no refunds will be issued, and the items will be considered
abandoned.

If a credit card cannot be processed due to insufficient funds or declined authorization, the buyer remains fully
responsible for the total amount due. Lightning Auctions reserves the right to pursue legal action and collection for
any unpaid invoices or refused payments.

All items are sold “AS IS, WHERE IS” without warranties or guarantees of any kind. Buyers are responsible for loading,
removal, packing materials, and transport.

If a customer is unable to load, Lightning Auctions staff may assist, but the company is not responsible for any
broken items, vehicle damage, or other loss that may occur during the loading process.
Any discrepancies must be reported at the time of removal — no exceptions.

Photos & Descriptions
All photos and item descriptions are the property of Lightning Auctions Inc. and may not be reproduced or reused
without written permission. All items not removed by the deadline will be considered abandoned and may be
disposed of or resold at Lightning Auctions’ discretion.

Legal Agreement
By placing a bid, you are entering into a legally binding contract and agree to complete your purchase if you win.
Bidders expressly agree not to stop payment, dispute, or contest this transaction.
Lightning Auctions and its consignors reserve the right to remove items from sale at any time.

Storage & Abandonment Policy
Due to limited space, all items must be paid for and removed within 3 business days following the auction. Business
hours: Monday – Friday, 8:30 AM to 5:00 PM (Closed on Thursdays and for lunch from 12:00 PM – 12:30 PM).

If items are not picked up within 10 days, they will be considered abandoned, and payment will be forfeited. No
refunds will be issued.

Buyers may authorize another person to pick up their purchases. If special arrangements are needed, reply to your
emailed invoice to request an alternate pickup date before the deadline.

Invoice & Notifications
Lightning Auctions will send an invoice as a courtesy to each winning bidder on the day following the end of the
auction. All emailed invoices are sent as a courtesy only, and it is the buyer’s responsibility to check and confirm
whether they are the winning bidder and to follow through with the purchase terms as stated.

Unsold Lots
Unsold lots are subject to the same terms as winning lots and will be considered abandoned if not removed or
claimed within 10 days. Lightning Auctions may dispose of or resell unsold items at its discretion.

Condition & Authenticity
Lightning Auctions Inc. makes no guarantees or warranties, expressed or implied, regarding:
 Condition or completeness
 Description accuracy
 Authenticity, provenance, or age
 Merchantability or fitness for purpose

Buyers must rely solely on their own inspection and judgment when bidding. All sales are final. No returns or refunds.

Payment & Settlement
All purchases must be paid for the day of sale, unless otherwise specified. Returned checks are subject to a $15
handling fee. No items may be removed until full payment is received.

Loading Assistance
If you require loading assistance, please call ahead so staff can plan accordingly. Lightning Auctions is not
responsible for any damage or loss that occurs during the loading or removal process.

Bidding Disputes & Auctioneer Rights
 Reject any bid
 Determine the successful bidder
 Reopen bidding in the event of a dispute
 Combine or divide lots at any time

All sales records and recordings are final and conclusive. Buyers are responsible for their purchases immediately
upon being declared the winning bidder.

Liability
Lightning Auctions Inc. is not responsible for accidents on the premises. All persons attending preview, sale, or
removal assume full responsibility for their own safety and property.

By registering to bid in any Lightning Auctions Inc. online auto auction, you are entering into a
binding legal contract agreeing to the following Terms & Conditions. Registration constitutes
acknowledgment and acceptance of all terms below.

1. GENERAL
All bidders must register online and provide complete, accurate identification prior to bidding.
Lightning Auctions Inc. is required by Nevada law to collect state sales tax (8.265%), unless a
valid resale or dealer exemption is on file before registration. Dealer licenses and resale
certificates must be on file prior to auction closing. Once registered, tax status cannot be
amended. Lightning Auctions Inc. is a licensed Nevada car dealer (#397) and operates in
compliance with Nevada DMV regulations. All vehicles sold to Nevada residents will be
processed with a Dealer Report of Sale (DRS) and receive a temporary 30-day placard upon full
payment. Titles are submitted to the Carson City DMV; new titles are mailed by the DMV within
4–8 weeks of registration.

2. VEHICLE CONDITION & DESCRIPTION
All vehicles are sold AS-IS, WHERE-IS, without any warranty—expressed or
implied—including merchantability or fitness for a particular purpose. Descriptions, photos, and
condition reports are provided for convenience only and are not guaranteed. It is the bidder’s
responsibility to inspect vehicles in person during scheduled preview hours before placing bids.
Lightning Auctions Inc. makes no guarantees regarding accuracy of odometer readings, options,
or running condition.

3. ONLINE BIDDING & CONTRACT AGREEMENT
By clicking “Register to Bid,” “Agree,” or placing a bid, you are entering into a binding
purchase contract with Lightning Auctions Inc. Bids cannot be retracted or canceled once placed.
Winning bidders are legally obligated to complete payment and pickup within the stated time
frame. Failure to pay or pick up will result in forfeiture of deposit, possible resell, and liability
for losses or fees incurred by Lightning Auctions.

4. PAYMENT TERMS
A non-refundable deposit equal to ten percent (10%) of the total purchase price or Five Hundred
Dollars ($500.00), whichever is greater, is automatically due immediately upon auction close.
Final payment of the remaining balance must be received no later than 5:00 PM on the Tuesday
following the auction close.

Accepted forms of payment include Cash, Cashier’s Check, Visa, MasterCard, and Debit Card.
Failure to remit full payment by the stated deadline shall constitute a default by the Buyer. In the
event of default:

1. The Buyer shall immediately forfeit the non-refundable deposit.
2. The Buyer shall forfeit all rights, title, and interest in the vehicle or asset purchased.
3. The Seller may retain possession of, repossess, or resell the vehicle or asset without
further notice to the Buyer.
4. The Buyer shall remain fully liable for the entire invoice amount, together with any
applicable fees, costs, damages, collection expenses, attorney fees (where permitted by
law), and any deficiency resulting from resale.
5. Any unpaid balance may be referred to a third-party collection agency and/or pursued
through legal action. The Buyer agrees to be responsible for all reasonable costs
associated with collection of the debt.

By placing a bid, the Buyer acknowledges and agrees that bids are binding and that failure to
complete payment does not relieve the Buyer of their obligation to pay the full invoice amount.

5. BUYER’S PREMIUM
10% Buyer’s Premium for Cash or Check; 13% Buyer’s Premium for Credit or Debit Card.
Buyer’s Premium is subject to applicable sales tax.

6. FEES
Document Fee: $349.50 (non-refundable). Title Fee: $28.50 per vehicle. Smog Fee: $29.50 if
applicable. Diesel Emission Fee: $99.00 if applicable. Sales Tax: 8.265% (Washoe County)
applied per law. Paperwork will be completed by scheduled appointment only.

7. PREVIEW & PICKUP
Preview Location: 2021 Glendale Ave., Sparks, NV. Preview and inspection available Friday &
Saturday before auction close. Pickup Hours (By Appointment Only): Monday–Wednesday
following auction. All vehicles must be paid in full and removed by the end of Wednesday. Late
pickups may incur storage fees or forfeiture.

8. EMISSIONS NOTICE (NRS 445B.770)
Consignment auctions and consignees are not required to obtain emissions inspections or tests as
required by NRS 445B.770. It is the buyer’s responsibility to complete any required emissions
inspection prior to registration.

9. NOTICE TO BUYERS
All vehicles are sold AS-IS, WHERE-IS, with no warranties expressed or implied. Lightning
Auctions Inc. is not responsible for errors or omissions in listings. All sales are final, and all fees
and taxes must be paid before vehicle release. Lightning Auctions is not responsible for loss,
theft, or damage once the vehicle is sold; buyers are encouraged to insure their purchase
immediately upon sale.

10. DEFAULT, STORAGE, & FORFEITURE
Failure to pay or remove a vehicle within the stated time will result in loss of deposit, bidding
suspension or account termination, and resale of the vehicle without further notice. Buyer is
responsible for any resulting deficiency and associated costs.

11. GOVERNING LAW
These Terms & Conditions are governed by the laws of the State of Nevada, and any disputes
shall be resolved in Washoe County, Nevada.

*Smog and Diesel Emission fees apply only if required by law or vehicle type.
